What is a SR-22?

Under California DUI laws, a SR-22 insurance certificate filing, or "Financial Responsibility Form" is required by the California Department of Motor Vehicles (DMV) for problem drivers. The SR22 is an official California proof of insurance certificate that must be held on file at the DMV for a specific amount of time. A SR-22 filing is usually required when an individual is arrested for Driving Under the Influence (DUI) or Driving While Intoxicated (DWI) in California. The DMV will not accept any other document as a substitute for the SR-22 form.

If you are suspected of DUI or a convicted DUI-DWI offender, the SR-22 form will enable you to obtain a restricted driver's license, to restore your suspended driver’s license, or get a vehicle registered at the local Department of Motor Vehicles (DMV). Individuals convicted of "Wet Reckless," rather than a DUI-DWI, will also need to provide a SR-22 form to the DMV.

The SR22 filing is issued by an insurance company who specializes in SR-22 high risk insurance coverage. Not all insurance companies provide SR22 coverage. The filing provides proof to the state DMV that an insurance company has issued at least the minimum liability car insurance coverage for the person making the filing and it is a requirement that the insurance company notify the DMV if your car insurance ever lapses for any reason.

If you are required to file an SR 22 with the DMV and your DUI auto insurance coverage is cancelled, dropped, or lapses for any period of time, the insurance company will immediately notify the DMV. When the California DMV receives that notice, they will then notify you that you must file another SR-22 with them by a certain date or they will issue an Order of Suspension on your driver's license.

As long as you do not cancel your car insurance policy or get dropped by the insurance company during the specific time required to maintain an SR-22, your proof of insurance will remain active and you do not need re-submit an SR-22.

A California SR-22 is only valid for California. If you move to another state you may need a different SR-22 or form to show proof of financial responsibility in that state.
